Terms of service
These Terms govern your use of Aura AI, the AuraAI Cloud backend, and the AuraAI Premium subscription (collectively, Services) provided by Vrygen.
By installing, launching, or using the App you agree to these Terms. If you do not agree, do not install or use the App.
1. Eligibility
- You must be at least 16 years old if you reside in the European Economic Area or the United Kingdom, or at least 13 years old elsewhere, to use the App. If you are under the age of majority in your jurisdiction, a parent or legal guardian must consent to these Terms on your behalf.
- The App is not directed to children under those ages and we do not knowingly collect data from them.
- You are responsible for ensuring that your use of the App complies with the laws of your jurisdiction.
2. The service
Aura AI is a desktop client that:
- Lets you chat with AI language models, either via the AuraAI Cloud default backend (free 10 messages/day, Premium unlimited messages/day) or via a third-party provider you configure yourself (OpenAI, Anthropic Claude, OpenRouter, Ollama, LM Studio, or any OpenAI-compatible endpoint).
- Stores conversations, settings, and any API key you enter locally on your device (encrypted at rest with Windows DPAPI).
- Optionally uses Windows speech recognition for voice input.
There is no user account and no sign-in. Your installation is identified by a random installation identifier generated locally.
3. AuraAI Premium subscription
- AuraAI Premium is sold as a Microsoft Store subscription currently listed at $5.99 per month before any applicable taxes, currency conversion, or regional Store adjustments. Microsoft collects and processes payment information under its own terms; we do not see or store your payment details.
- Subscriptions auto-renew monthly at the final price and interval shown in the Microsoft Store at the time of purchase, unless cancelled by you.
- Refunds and cancellations are handled exclusively through the Microsoft Store under its standard refund policy. We do not process refunds ourselves.
- Active Premium status is verified locally against your Microsoft Store license and then reported to the AuraAI Cloud backend with your installation identifier so that unlimited AuraAI Cloud access can be applied.
- If a Premium subscription lapses or is cancelled, your installation reverts to the free quota at the end of the current billing period.
4. Acceptable use
You agree not to use the App or the AuraAI Cloud service to:
- generate content that is illegal under your local law, including child sexual abuse material, content inciting violence or terrorism, or unauthorised disclosure of personal data;
- harass, defame, or threaten any person;
- attempt to bypass quotas, rate limits, or authentication;
- reverse engineer, decompile, or otherwise attempt to derive the source code of the App or the backend, except to the extent permitted by mandatory law (e.g. EU Directive 2009/24/EC Art. 6 interoperability);
- automate or scrape the App or backend at a scale that constitutes abuse;
- impersonate Vrygen or another person, or misrepresent your affiliation;
- transmit malware, exploits, or otherwise interfere with the integrity of the Services.
We may terminate or rate-limit your installation at any time if we have a good-faith belief that it is being used in violation of these Terms.
5. AI-generated content
- AI models can produce inaccurate, biased, outdated, or fabricated output. You must not rely on AI responses for medical, legal, financial, safety-critical, or other high-stakes decisions, and you should verify important information from authoritative sources.
- You are responsible for how you use AI-generated output, including ensuring that publishing or redistributing it complies with the licenses and terms of the underlying model provider (e.g. OpenAI, Anthropic).
- Where applicable (e.g. EU AI Act Art. 50), the App labels AI-generated content as such inside the chat surface.
- You can report inappropriate AI-generated output from the chat surface. Reports are sent to support for review and appropriate follow-up.
6. Third-party AI providers
- When you select a third-party provider (OpenAI, Claude, OpenRouter, Ollama, LM Studio, or any compatible endpoint), your prompt and conversation context are sent directly to that provider under its own terms of service and privacy policy. We are not a party to that relationship.
- It is your responsibility to comply with each provider's terms, including any rate limits, content restrictions, and commercial-use restrictions.
- The App passes through the API key you supply; we do not transmit it to AuraAI Cloud or to Vrygen.
7. Intellectual property
- The App, including its source code distributed under the MIT License, and the AuraAI brand are the property of Vrygen and its contributors.
- "Aura AI", "AuraAI Cloud", and "AuraAI Premium" are trademarks of Vrygen.
- Subject to applicable model providers' terms, you retain ownership of your prompts and of the AI outputs you receive. We claim no ownership of either.
- Open-source components used by the App are listed in the third-party notices with their licences.
8. Privacy
Your use of the App is also governed by our privacy policy, which forms part of these Terms.
9. Disclaimers
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING WITHOUT LIMITATION ANY WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, OR THE ACCURACY, RELIABILITY, OR AVAILABILITY OF AI OUTPUTS.
To the maximum extent permitted by law, we do not warrant that the Services will be uninterrupted, secure, or error-free, that defects will be corrected, or that the Services or the servers they run on are free of viruses or other harmful components.
Nothing in this section limits or excludes any warranty that cannot be limited or excluded under your local law (e.g. statutory consumer rights in the EU, UK, France, or other jurisdictions).
10. Limitation of liability
To the maximum extent permitted by applicable law:
- In no event will Vrygen, its officers, employees, or contributors be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including loss of profits, loss of data, or loss of goodwill, arising from or in connection with your use of the Services, even if we have been advised of the possibility of such damages.
- Our aggregate liability for any claim arising from these Terms or the Services is limited to the greater of (a) EUR 50 or (b) the total amount you paid to Vrygen (via the Microsoft Store) for Premium in the twelve months preceding the claim.
- These limitations do not apply to (i) liability for death or personal injury caused by negligence, (ii) fraud or fraudulent misrepresentation, or (iii) any other liability that cannot be limited under applicable law.
11. Indemnification
To the extent permitted by law, you agree to indemnify and hold harmless Vrygen and its contributors from any claim or demand, including reasonable legal fees, arising out of your breach of these Terms or your violation of any law or third-party right through your use of the Services.
12. Changes to the Services or Terms
- We may modify the Services, including the free quota, Premium access, the set of supported AI providers, or the backend pricing, at any time. Material changes will be reflected in the App or its release notes.
- We may modify these Terms; the updated version will be published with a new "Last updated" date. Your continued use of the Services after a change constitutes acceptance of the updated Terms.
13. Termination
You may stop using the App at any time and uninstall it via Windows Settings. The App's Privacy & data panel lets you export and then delete every chat, setting, API key, cached token, and installation identifier on your device.
We may suspend or terminate your access to AuraAI Cloud if you violate these Terms, if continued service would expose us to legal risk, or if your installation is part of an abuse pattern (e.g. mass automated requests).
14. Governing law and dispute resolution
- These Terms are governed by the laws of France, without regard to its conflict-of-law rules. Mandatory consumer-protection laws of your country of residence continue to apply.
- Any dispute that cannot be resolved informally will be brought before the competent courts of France. Consumers domiciled in another EU Member State retain the right to bring proceedings in the courts of their residence.
- EU consumers may also use the European Commission's Online Dispute Resolution platform.
